Former Vice President Kamala Harris sharply criticized federal immigration agents after a man was fatally shot during an attempted vehicle stop, arguing that the incident demands an independent investigation.
“Joan Sebastian Guerrero should still be alive,” Harris wrote in a post on X. She claimed it was the second time in one week that Immigration and Customs Enforcement agents had killed someone who, according to the agency’s own account, was not the original target of its operation.
Harris also drew attention to the presence of Guerrero’s young daughter, writing that the three-year-old witnessed her father’s death while wearing Bluey pajamas.
“This cannot be acceptable in America,” Harris said. “There must be an immediate, independent, and transparent investigation. Anyone responsible for wrongdoing must be held accountable.”
Her statement quickly drew criticism from people who accused her of condemning the agents before all the facts had been established. The circumstances surrounding the shooting remain disputed, with ICE and at least one witness saying the driver appeared to use his vehicle in a way that endangered officers.
According to a statement provided by ICE, agents were conducting surveillance at the last known address of an undocumented immigrant who had received a final order of removal. The agency said a vehicle left the residence and that officers attempted to stop it.

ICE claimed the driver tried to flee. An officer, fearing for public safety, fired his weapon and struck the driver. Emergency medical services were contacted, but the man later died from his injuries.
A witness identified as 18-year-old Lucas Scott offered an account that appeared to support the agents’ claim that they faced an immediate threat. Scott said the vehicle had been surrounded and that the driver put it into gear before attempting to drive toward an ICE officer.
“The car was put into drive and was trying to hit the ICE officer,” Scott said.
The shooting occurred amid heightened scrutiny of ICE enforcement tactics. Another recent incident in Texas also involved an ICE agent fatally shooting a driver who authorities said attempted to ram an officer with a vehicle. Following the Maine shooting, ICE temporarily paused certain traffic-stop operations, according to news reports.
President Donald Trump responded by defending ICE agents and urging the agency not to abandon traffic stops as an enforcement tool.
Trump praised ICE personnel and argued that aggressive immigration enforcement remains necessary to remove people who entered the country illegally, particularly those with criminal records. He said agents must remain “strong, tough, and smart,” while also telling them to act fairly and carefully.

His comments framed the dispute as part of a larger political battle over immigration enforcement. Trump and his supporters argue that traffic stops are an essential tool for locating and arresting people who are subject to deportation. Critics, including Harris, say recent deaths raise serious questions about whether agents are using excessive or unnecessary force.
Harris is right that any fatal law-enforcement encounter should be thoroughly investigated. Transparency is especially important when the government takes a life. However, calling the incident an unjustified “killing” before an investigation is complete risks ignoring evidence that the agents may have been responding to an immediate threat.
A vehicle can become a deadly weapon within seconds. If the witness account and ICE’s statement are accurate, the officer may have believed that his life or the lives of others were in danger. That does not mean the shooting should escape scrutiny, but it does mean political leaders should avoid declaring guilt before investigators examine video, witness statements, ballistics evidence, and the actions of everyone involved.
The death is tragic, particularly because a young child was reportedly present. That emotional detail deserves compassion, but it should not replace a careful review of the facts.
An independent investigation can determine whether the officer acted lawfully, whether ICE followed proper procedures, and whether different tactics could have prevented the loss of life. Until that process is complete, elected officials should resist turning a disputed and painful incident into a political verdict.
