Jack Phillips, the owner of Masterpiece Cakeshop, has finally reached the end of a grueling 12-year legal journey defending his right to free speech and religious freedom. On Tuesday, the Colorado Supreme Court dismissed a lawsuit against him, effectively ending a prolonged legal battle over his refusal to create a custom cake celebrating a gender transition. The case has been emblematic of the broader debate over the limits of anti-discrimination laws and the protections afforded by the First Amendment.
The lawsuit’s origins trace back to 2017, when attorney Autumn Scardina contacted Phillips on the same day the U.S. Supreme Court announced it would hear his first case. Scardina requested a pink cake with blue frosting to symbolize a gender transition, a clear challenge to Phillips’ known religious stance on marriage and gender identity. When Phillips declined the request on grounds of his beliefs, Scardina filed a complaint with the Colorado Civil Rights Commission, accusing him of discrimination under the state’s Anti-Discrimination Act (CADA).
The original complaint was settled after a lengthy dispute, but that was not the end of Phillips’ legal woes. In 2019, Scardina took the battle back to court by filing a new lawsuit, prompting yet another round of legal challenges for the beleaguered baker. However, on Tuesday, the Colorado Supreme Court ruled that Scardina’s case had procedural flaws. The court found that instead of filing a new lawsuit, Scardina should have appealed the Civil Rights Commission’s decision to close the initial complaint. Consequently, the lawsuit was dismissed, marking a significant victory for Phillips.
In its decision, the court vacated earlier rulings by lower courts and made it clear that it was not taking a stance on the underlying merits of Scardina’s claims. It emphasized that the dismissal was based solely on procedural grounds and did not alter the existing protections under CADA. While the ruling sidestepped the broader cultural issues at play, it brought a long-awaited conclusion to a legal saga that had dragged Phillips through the courts for more than a decade.
Alliance Defending Freedom (ADF), the legal organization representing Phillips, welcomed the dismissal. Jake Warner, a senior counsel for ADF, stated, “Enough is enough. Jack has been dragged through courts for over a decade. It’s time to leave him alone. Free speech is for everyone.” The sentiment captures the exhaustion felt by many who have followed Phillips’ legal battles, which have come to symbolize the clash between religious freedom and anti-discrimination efforts.
Phillips’ legal journey has included a landmark 2018 U.S. Supreme Court ruling in his favor, which found that the Colorado Civil Rights Commission had shown hostility toward his religious beliefs when penalizing him for refusing to make a custom cake for a same-sex wedding. The Supreme Court’s decision emphasized that anti-discrimination laws must be applied in a manner that respects religious freedom. More recently, in June 2023, the Supreme Court ruled in favor of Lorie Smith, a Christian web designer who similarly argued that Colorado could not compel her to create content for same-sex weddings in violation of her beliefs. Justice Neil Gorsuch, writing for the majority, underscored that the First Amendment guarantees the freedom to think and speak without government coercion.
