Uber tried to charge the parents of a dead daughter $10 million if they spoke the truth. This demand came right after a judge ordered the ride-share giant to pay the family $40 million. The company wanted to bury the facts about how their driver killed a young woman on a California freeway.

Carol Normandin and Ken Parker won their case in March after a five-day hearing. They received $20 million each for the loss of their 23-year-old daughter, Emily Normandin-Parker. The company threatened a massive penalty to keep the family quiet about their negligence.

Uber chiefs feared the public would see their driver’s reckless actions. They sent an agreement requiring non-disparagement to the grieving parents. Parker told Good Morning America that the company almost immediately started contending that the award could not be made public.

The Night the Driver Chose His Car

The tragedy happened in the early hours of August 12, 2023, in Costa Mesa. Emily and her friend Luna Moore got into an Uber after a night out. Moore vomited in the car, and driver Vu Tran ordered them to get out.

A gore point separating State Route 73 from an exit ramp was where Tran parked illegally. He wanted a cleaning fee while his passengers stood near fast-moving traffic. Judge Richard A. Stone ruled that Tran needlessly placed them in danger by stopping there.

The judge observed that Tran demonstrated “far more worry for his new car than he did for his passengers”, according to the New York Post. According to reports, an angry impulse led him to illegally halt at the gore point, needlessly endangering both himself and the others. Emily was struck by traffic while Moore argued with the driver.

Lawyers argued Tran had a history of “reckless” behavior with previous riders. One customer claimed Tran was “the least safe” ride they had ever experienced. Tran tried to blame Emily for walking into traffic, but the judge rejected that excuse.

What the Arbitrator Said About Safety

Uber claimed they were not at fault for the tragic events of that night. A spokesperson said their “thoughts continue to be with the Normandin-Parker family.” They added that they respect the arbitration process but believe the arbitrator was wrong to hold them responsible.

The company stated they have “continued to strengthen our approach to safety over the years”. They asserted that this includes providing extra instructions for motorists on steering clear of unsafe drop-off spots. Yet the driver who killed Emily had a record of complaints.

This case shows how a corporate shield can hurt real families. The $40 million award is a victory, but the threat of silence shows the company’s true priorities. Parents trusted Uber to get their daughter home safely, and that trust cost her life.
